I found the distinction between jobs that require "invention, imagination, originality or talent" as opposed to "intelligence, diligence and accuracy" to be amusing.
I feel I need all of the above in my line of work.
And the last time anyone ever offered me overtime was at the local PBS affiliate. I spent most of my time on the run from the "you must bill all your overtime" police, because it was the only way
I could get the job done at my own pace to my own satisfaction. Somehow, those folks never seemed to understand that you just can't put your name on something you're ashamed of.
Oh well. I do have sympathy for those who actually used to have overtime benefits and who will now lose them.
Best,
Shirley

The key paragraph:
------
The crux of this exemption [from overtime requirements] is the use of
invention, imagination, originality or talent, as opposed to work that
depends upon intelligence, diligence and accuracy. While determined on
a case-by-case basis, examples of fields recognized by this exemption
include actors, musicians, composers, conductors, soloists, painters,
cartoonists (who are merely told the title or concept and must rely on
their own creative ability), essayists, novelists, short-story writers
and screen-play writers. The imagination requirement is generally not
met by copyists, animators and retouchers of photographs, as this work
has been deemed not creative in nature.
____
This both cracks me up, and kinda worries me. My novelist friends are
going to be shocked that they'll no longer qualify for overtime. My
musician friends (a couple of whom work in Las Vegas) are not going to
be happy. My animator friends will feel insulted, but perhaps not so
insulted that they'll complain (besides, they're pretty happy where
they are).
Nevada's a a right-to-work state, so I guess this change shouldn't
surprise us.
Not good for California, but I still think your/our offshore worries
are a bigger issue.
Sigh.
