Looks like this is the answer:
Attention Avid customer:
Avid has discovered an issue with the Avid NewsCutter 10.0.1 software that was available on our Download Center between February 6 and May 9 2012. Our records show that you may have downloaded this software.
The issue has been resolved, and an updated build of NewsCutter 10.0.1 is available now on the Download Center.
Problematic Build: NewsCutter 10.0.1 b26175
Updated Build: NewsCutter 10.0.1 b26235
Issues:
- Customers who have installed NewsCutter 10.0.1 build 26175 may not be able to install the 10.0.1.1 patch
- Build 26175 is missing important bug fixes included in 26235
Resolution:
- Customers who have installed build 26175 need to uninstall their current Avid NewsCutter application, and install the updated 26235 build.
- No other applications are affected or require any changes
Important Note:
- Only software obtained from the Download Center is affected.

Not an answer but would it make sense to uninstall newscutter and then reinstall it then run the patch installer. I'm wondering if the uninstall would refresh the path memory so the patch would find the original version and act accordingly.
