Standard CC vendors are used to working with visuals that have been designed without regard to captioning. The caption position will be shifted as necessary to minimize interference with on screen elements. Captions can be moved up/down/left/right into about 9 standard positions. In drama, they are shifted to associate best with the speaker. In non-fiction they generally remain bottom center, but they are commonly moved to the top of screen briefly to avoid covering ID text, or just above the ID if that works better. Obviously you can minimize this by considering captions when designing your visuals, but it's tough.
Consult with a closed caption provider for guidance. We like National Captioning Institute (NCI) in the Washington, DC metro area.
