If you don't have permission, it's a copyright infringment. If you're using
it for profit, it's a copyright infringement. Then you fall into the gray
area of fair use. In theory you can use x many seconds as long as it doesn't
take away from the entirety of the original work. In my law class my
professor would use the example, if you can recognize it, you're taking away
from the entirety of the work. News, Education and some other areas have a
much larger gray area to dance in that those of us doing for profit. Fair
use is a very skinny line and for me it's just easier to never take that
dance.

As for what ever shows up on youtube, they'll probably never get busted for
it, much like the small budget local advertisers that get someone
inexperienced to edit and want their favorite song as the soundtrack.
Everyone in a while they get caught and there goes their career.
