RE: [Avid-L2] I'm an editor, just shoot me

And if the producer was paying for the rights to use this material would they be more likely to pay a decent wage for the editor? The above the line stuff is what drives all below.

true. i started this thread to talk about the self inflicted wound to the worth of the editor. People taking work for no pay or very low pay. Amateurs selling themselves as editors. And clients expecting less and less from their editors because these amateurs are not up to the real work of an editor. software operators not editors.

We seem to have strayed from the core point of this conversation,  which is the general perception of the value and worth of an editor -- generally accepted as about the same as the value of Pete's legal advice.

A long time ago I was asked to edit a commercial that was staged as a news report including the use of the phrase Eyewitness News. I offered that such a spot might be illegal under copyright infringement. The client countered that he was a lawyer and he didn't think so. I was still nervous about being involved and on a break went to the Production Manager at the facility about it. He came into the session and told the client: "We can do this for you, but no one will air it. The station which uses Eyewitness News as their moniker will turn it down as it competes and confuses with their news department. The other stations will turn it down because it promotes Eyewitness News." The client thought about it for a moment and then cancelled the session. I imagine this client's losses probably exceeded $.50.

Moral: The letter of the law does not necessarily reflect how people will attempt use material. If there is an 'unfair' use of these trailers, the distributor/exhibitor is the one with the most at stake. And the loss of the "10 sec trailer" company's business is most likely dwarfed by the potential loss inflicted by an angry major studio.

P.S. My legal advice is free, and worth every penny.
